Criminal Background Checks

Adopted by Ute Conference Inc. Board of Directors on April 8, 2005

Overview

The Ute Conference Inc. hereby adopts a criminal history background check process for coaches, other volunteers and employees.

The Ute Conference Inc. provides leadership and resources focused on providing a safe and positive experience for youth and adults participating in football. The enormous growth of youth participation in the sport, and the commensurate growth of volunteers working with youth in its programs, necessitates consideration of ways in which coaches, volunteers and employees are solicited, selected, trained and retained.

The Criteria Adopted by the Ute Conference Inc.

Convictions for any of the five following categories of crimes (a “criterion offense”) will prompt a determination that an applicant does not meet the criteria to serve as a coach, volunteer or employee of the Ute Conference Inc..

A conviction is defined on the basis of exposure for the offense for which the defendant was convicted, pled guilty or pled nolo condendere, including a plea in abeyance (under § 77-2a-1 et seq. U.C.A., or under comparable provisions or practices under the laws of a jurisdiction other than Utah). If a charge is pled down (not including the final disposition of a plea in abeyance), the crime to which the applicant ultimately pled shall determine the qualification of the candidate.

  • Any felony (any crime punishable by confinement of greater than one year, regardless of how characterized by jurisdiction, if range, alternate sentencing or indeterminate sentencing provides that the outer range is greater than one year.);
  • Any lesser crime involving force or threat of force against a person;
  • Any lesser crime in which sexual relations is an element, including “victimless” crimes of a sexual nature (including pornography);
  • Any lesser crime involving controlled substances (not paraphernalia or alcohol); or
  • Any lesser crime involving cruelty to animals.

For purposes of convictions taking place in the state of Utah (a) the term “lesser crime” shall mean a misdemeanor; and (b) the term “nolo condendere” shall mean “no contest.”

“Red Light / Green Light” System

The Ute Conference Inc. shall utilize a procedure that can be referred to as a “Red Light / Green Light” protocol. This process increases the likelihood that the sensitive nature of the details of a “Red Light” determination will remain confidential. For instance, the firm or agency conducting the background check (the “Provider”) will utilize a “Red Light / Green Light” system to inform the Ute Conference Inc. whether or not an individual meets the above-referenced criteria to serve as a coach, volunteer or employee of the Ute Conference Inc..

A “Red Light” indicates that:

  • The applicant does not meet the criteria,
  • The applicant has been convicted of a criterion offense, and/or
  • The applicant is a sex offender registrant.

A “Green Light” indicates that:

  • The applicant meets the criteria,
  • The applicant has no criminal record, and/or
  • The crime for which an applicant was convicted is not a criterion offense.

Criminal Background Check Process

Prospective coaches, volunteers and employees shall complete a confidential application authorizing the check and providing an opportunity to disclose any offenses. The completed form is submitted directly to the Provider, and the background check is conducted. If the check results in a “Green Light,” the authorized representative of the Ute Conference Inc. is informed of such result. If the check reports criminal records that may result in a “Red Light”, the records will be mailed to the applicant and the Ute Conference Inc. will be notified of the “Red Light” designation.

Once notified, the applicant has the opportunity to appeal the accuracy of the record. This limited appeal will be reviewed by the Executive Committee. The nature of the appeal is to correct an error (e.g. name, record should have been expunged, not the correct record, etc.). A “Red Light” may also result from an incomplete record. False information from the applicant should be reviewed in the initial application process so that a “Red Light” designation results from a criminal conviction, not an incorrect application.

Confidentiality

The Ute Conference Inc. will endeavor not to disclose background check information to anyone other than the applicant, and internal organization employees, board members and others with a need to know such information.

Notification to Applicants

The Ute Conference Inc. will clearly notify an applicant that a criminal background check will be conducted and that a “Red Light" will result in a denial of right to participate/serve and to be a Ute Conference Inc. member.

Coaches Payment Agreement - All payments processed by Ute Conference, Inc.

As of July 15, 2009 ALL COACHES/VOLUNTEERS ARE REQUIRED TO MAKE PAYMENT ON THIS FORM IN ORDER FOR IT TO BE PROCESSED. Please complete the payment process on the Ute Conference Website and then you will go directly into the background check system to complete the process.

A. I am applying for a volunteer position, that I am not an employee of the Ute Conference, Inc., and will not receive any compensation for my efforts. I further understand that my purpose is to acquaint players with the rules and fundamentals of the game of football and to help maintain a sound physical, mental and moral condition. I also understand the Ute Conference, Inc. does not condone any type of unruly behavior or violence by players, coaches or parent. As a coach I will control my players and parents of my team.

B. I also understand that as a coach I must read the Ute Conference, Inc. Bylaws, and will follow the bylaws, rules and procedures set by the Ute Conference, Inc. and/or District. I understand that I may be dismissed at any time by the District President and/or the Ute Conference Commissioner for violation of the bylaws, rules or procedures.

C. Neither the Ute Conference, Inc. nor any District provides liability insurance that will protect me while participating in the Ute Conference football program.

D. The Ute Conference may conduct a background check on me.
